1.1. The official website of the Jacob Hotels chain, at www.jacobhotels.com (the “Site”), is operated by Resort Hadera Ltd., Company No. 515358059, as well as by the companies listed at the bottom of these Terms of Use (collectively, the “Company”). The Site provides information about the Jacob Hotels chain and enables the booking of accommodation services, vacation packages, and additional services at the chain’s hotels (the “Hotels”).<\/p>\n\n\n\n
1.2. The provisions of this document, including the Terms of Use, the Privacy Policy, and the Cookie Policy (collectively, the “Terms of Use”), apply to any use of the Site and constitute the legal basis for any engagement or matter between the Site user (the “User”) and the Company.<\/p>\n\n\n\n
1.3. Any use of the Site, including browsing, reviewing information, or placing an order, constitutes the User’s confirmation of, and agreement to, all provisions of the Terms of Use. A User who does not agree to the Terms of Use, in whole or in part, is requested to refrain from any use of the Site.<\/p>\n\n\n\n
1.4. The Company reserves the right to update, change, or amend the Terms of Use from time to time, at its sole discretion, without the need to give prior notice. The updated version published on the Site shall be the binding version.<\/p>\n\n\n\n
1.5. The User represents and confirms that all information, content, designs, images, trademarks, logos, and any other material appearing on the Site (the “Information”) are the property of the Company, and are protected, among other things, under copyright, trademark, and intellectual property laws. The User undertakes to make personal and private use of the Information only, and not to copy, duplicate, distribute, publish, publicly display, photograph, process, translate, or otherwise use the Information, in whole or in part, without the Company’s prior written consent.<\/p>\n\n\n\n
1.6. The User undertakes not to perform any action that may distort, alter, or harm the Information appearing on the Site, its reliability, integrity, or manner of presentation, and to refrain from any action that may harm the Company’s reputation, goodwill, or rights.<\/p>\n\n\n\n
1.7. For convenience purposes only, some of the content on the Site and\/or in this document is phrased in the masculine form; however, it is intended for, and refers to, all genders equally.<\/p>\n\n\n\n

For these Terms of Use, “Services” means all accommodation services, vacation packages, products, and other services offered for sale or booking through the Site, as updated from time to time.<\/p>\n\n\n\n
The Company does not undertake to offer any particular range of services on the Site or to continue offering a particular service for any period of time. The Company may, at its sole discretion and at any time, add, remove, change, update, replace, or discontinue the offering of services on the Site, in whole or in part, without prior notice, all subject to the provisions of any law.<\/p>\n\n\n\n
4.1. Any user may place an order for services through the Site, provided that they have the legal capacity to perform binding legal acts in accordance with the provisions of any law. By placing an order, the User represents and confirms that they are at least 18 years old and are legally competent to enter into a binding agreement.<\/p>\n\n\n\n
4.2. The Company reserves the right, at its sole discretion, to deny a user access to the Site or the ability to place orders through it, and to refuse to accept an order or to cancel an order, among other things, if the User acted in breach of the Terms of Use, provided false or misleading details, made unlawful use of the Site, or performed any act that may harm the Site, the Company, other users, or the proper management of the Site.<\/p>\n\n\n\n
4.3. The Company may limit the number of orders or the scope of services that may be ordered through the Site, in whole or in part, at its sole discretion and in accordance with operational needs, availability of services, or any other reasonable reason.<\/p>\n\n\n\n
5.1. Services available for booking<\/p>\n\n\n\n
5.1.1. Hotel accommodation services \u2013 Accommodation services at the Company’s hotels listed on the Site may be booked through the Site or through the Company’s telephone reservations center. Telephone bookings may be made through the reservations center at: 04-8866705.<\/p>\n\n\n\n
5.1.2. Spa services \u2013 Spa services at participating Company hotels may be booked through the Site or through the telephone reservations center.<\/p>\n\n\n\n
5.1.3. Restaurants \u2013 The Site may display information about restaurants operating at the Company’s hotels in Israel. Reservations at restaurants, to the extent available, will be made through a third-party website or reservation system, as detailed on the Site. The Company is not responsible for the operation of the external booking site or the services provided through it, and its use is subject to that third party’s own terms.<\/p>\n\n\n\n
5.2. Booking as a Guest<\/p>\n\n\n\n
A user may place an order on the Site without prior registration (a “Guest Booking”). To complete the order, the user must provide the details requested on the Site. Providing all required details is a condition for completing the order.<\/p>\n\n\n\n
5.3. Booking via a User Account<\/p>\n\n\n\n
To the extent the Company permits it, a user may place an order using a registered user account and\/or as a member of the Company’s loyalty club, all subject to the Site’s Terms of Use and the terms of the customer club, to the extent such terms exist and have been published.<\/p>\n\n\n\n
5.4. Manner of Placing an Order<\/p>\n\n\n\n
After selecting the requested service, including the hotel, room type or service, stay dates, number of guests, and any other relevant details, the user will complete the ordering process in accordance with the Site’s instructions. As part of the order, the user will be required to provide personal details, contact details, and payment details, to complete, secure, and guarantee the order, in accordance with the payment methods available on the Site and these Terms of Use. Without providing the required details, the order cannot be completed.<\/p>\n\n\n\n
5.5. Method of Payment<\/p>\n\n\n\n
Unless otherwise stated in the order terms, payment for accommodation services will be made when the service is received, directly at the hotel, using a payment method approved by the hotel.<\/p>\n\n\n\n
Notwithstanding the foregoing, in any other case explicitly stated when the order is placed, the user will be charged the full price, or part of it, at the time the order is placed.<\/p>\n\n\n\n
5.6. Group Bookings<\/p>\n\n\n\n
Bookings on the Site are limited to up to three (3) rooms per order. The Company may, at its sole discretion, treat several orders placed by the same user and\/or for the same stay dates and\/or for the same group as a group booking. In such a case, the Company may cancel the excess orders, offer different commercial terms, including a requirement to pay an advance payment or deposit, or refer the user to the group bookings department, all subject to the provisions of any law.<\/p>\n\n\n\n
5.7. Order Confirmation<\/p>\n\n\n\n
Upon completion of the order, and subject to the Company’s approval, an order confirmation will be sent to the user at the email address provided. The order confirmation will include, among other things, the order details and a confirmation number.<\/p>\n\n\n\n
For the avoidance of doubt, an order shall be deemed complete and binding only after the user has received a written order confirmation from the Company.<\/p>\n\n\n\n
5.8. Unavailability of Services<\/p>\n\n\n\n
If, after an order has been placed, it becomes apparent that one or more of the ordered services cannot be provided to the user, for any reason, including error, unavailability, full occupancy, or a system malfunction, the Company may cancel the order, in whole or in part. In such a case, the user will not be charged for the service that is not provided, or will be refunded any amount paid for it, as applicable, and will have no claim or demand against the Company as a result, other than the return of amounts actually paid for the service not provided. The Company will make reasonable efforts to update the user as soon as possible.<\/p>\n\n\n\n
5.9. Prices of Services<\/p>\n\n\n\n
The Company may update the prices of the services offered on the Site at any time, at its sole discretion and without prior notice. The binding price is the price displayed on the Site at the time the order is completed and confirmed. To the extent service prices are updated before the ordering process is completed, the user will be charged in accordance with the updated price displayed when the order is completed.<\/p>\n\n\n\n
6.1. Cancellation of a Transaction under the Consumer Protection Law<\/p>\n\n\n\n
A user who placed an order through the Site or through the Company’s telephone reservations center may cancel the transaction in accordance with the provisions of the Consumer Protection Law, 5741\u20131981 (the “Consumer Protection Law”).<\/p>\n\n\n\n
Without derogating from the provisions of the law, a distance-sale transaction may be cancelled within 14 days of the date the transaction was made or the date the disclosure document was received, whichever is later, provided that the cancellation date does not fall within seven (7) non-rest days before the date the service is scheduled to begin.<\/p>\n\n\n\n
A user who is a person with a disability, a senior citizen, or a new immigrant, as defined by law, may cancel the transaction within four (4) months of the date the transaction was made or the date the disclosure document was received, whichever is later, provided that the cancellation date does not fall within seven (7) non-rest days before the date the service is scheduled to begin, and that entering into the transaction included a conversation between the user and the Company, including via electronic communication, in accordance with the provisions of the law.<\/p>\n\n\n\n
In the case of a lawful cancellation under the law, the Company may charge a cancellation fee of 5% of the transaction price or NIS 100, whichever is lower, per room booked, all in accordance with the provisions of the Consumer Protection Law and provided the cancellation does not result from a defect or any other ground that precludes charging a cancellation fee under law.<\/p>\n\n\n\n
6.2. The Company’s Cancellation Policy<\/p>\n\n\n\n
Without derogating from the cancellation rights set out in the Consumer Protection Law, the following cancellation terms apply to orders placed through the Site:<\/p>\n\n\n\n
6.2.1. Bookings in a regular period \u2013 The order may be cancelled without a cancellation fee up to 12:00 noon, two days (48 hours) before the start of the stay at the Tel Aviv and Jerusalem hotels, and three days (72 hours) before the start of the stay at the other hotels.<\/p>\n\n\n\n
6.2.2. Bookings during holiday periods, special occasions, and special events \u2013 On dates determined by the Company from time to time, the order may be cancelled without a cancellation fee up to 12:00 noon, seven (7) days before the start of the stay.<\/p>\n\n\n\n
6.2.3. Late cancellation or no-show \u2013 In the event of cancellation after the dates set out above, or if the guest does not arrive at the hotel on the scheduled date, the Company may charge the user a cancellation fee equal to the cost of the first two nights of the booking during a regular period, or the full value of the booking during peak periods and special events, unless otherwise specified in the specific order terms.<\/p>\n\n\n\n
6.2.4. Cancellation of spa service bookings \u2013 A spa treatment booking may be cancelled free of charge up to 72 hours before the treatment date. Cancellation after this date, or failure to arrive for the treatment, will be charged the full price of the booked service.<\/p>\n\n\n\n
6.2.5. Bookings at a “Non-Refundable” rate \u2013 Bookings explicitly marked, at the time of booking, as a “Non-Refundable” rate cannot be cancelled, changed, or refunded, except in cases where a right of cancellation exists under law.<\/p>\n\n\n\n
6.3. Applicability of the Cancellation Provisions<\/p>\n\n\n\n
The provisions of this section apply only to distance-sale transactions made through the Site or through the Company’s telephone reservations center, and do not apply to orders made through a travel agent or any other party, unless explicitly stated otherwise.<\/p>\n\n\n\n
6.4. Methods of Submitting a Cancellation Notice<\/p>\n\n\n\n
A notice of cancellation of a transaction (the “Cancellation Notice”) may be submitted by any of the following methods:<\/p>\n\n\n\n

6.5. Cancellation Confirmation<\/p>\n\n\n\n
The Company will send the user confirmation of receipt of the cancellation notice by the means through which the notice was submitted, or by another means of contact provided by the user. To the extent a refund is required, it will be made in accordance with the provisions of the law and the terms of the transaction.<\/p>\n\n\n\n
6.6. Cancellation of an Order by the Company<\/p>\n\n\n\n
The Company may cancel an order, in whole or in part, upon notice to the user, among other things, in cases of a clerical or technical error in the price or description of the service, a system malfunction, unavailability of the service, force majeure, or any other circumstance beyond the Company’s control, or where there is concern of unlawful use of the Site or a breach of the Terms of Use.<\/p>\n\n\n\n
7.1. Prices and Taxes<\/p>\n\n\n\n
7.1.1. Prices displayed on the Site in Hebrew for hotels in Israel are stated in New Israeli Shekels (NIS) and include VAT as required by law, except for bookings for the Eilat hotel, to which the provisions of the Eilat Free Trade Zone Law (Exemptions and Tax Reductions), 5745\u20131985, apply, and prices will be displayed accordingly.<\/p>\n\n\n\n
7.1.2. Prices of services available to tourists (foreign residents holding a B\/2 or B\/3 tourist visa), as displayed on the English-language Site, are shown without VAT (0% VAT) and may be displayed in foreign currency. To the extent payment is made in New Israeli Shekels, the amount will be calculated according to the exchange rate set by the credit card company or payment service provider, unless otherwise stated when the order is placed, all subject to the provisions of any law.<\/p>\n\n\n\n
7.1.3. For the avoidance of doubt, booking services in Israel is subject to Israeli tax law. To the extent VAT is payable by law in connection with the order, the user will be charged VAT as required by law, regardless of the language of the Site through which the order was placed.<\/p>\n\n\n\n
7.1.4. The Company is not responsible for fees, exchange-rate differences, or additional charges levied by the credit card company, the bank, or any payment service provider in connection with the transaction.<\/p>\n\n\n\n
7.2. Changes to the Site and the Terms of Use<\/p>\n\n\n\n
7.2.1. The Company may update the Terms of Use from time to time. The updated Terms of Use will be published on the Site and will take effect on the date of publication, unless otherwise stated.<\/p>\n\n\n\n
7.2.2. The Company may, at any time and at its discretion, change the structure of the Site, its content, the services offered on it, its appearance, its availability, or any other aspect related to its operation, and may discontinue its operation temporarily or permanently, all subject to the provisions of law. Such changes shall not give rise to any cause of action for the user, except to the extent required by law.<\/p>\n\n\n\n
7.3. Room Availability<\/p>\n\n\n\n
All orders are subject to the availability of rooms and services at the time the order is placed and at the time the service is provided. Order confirmation will be given in accordance with actual availability. The number of places at the Company’s hotels is limited, and placing an order for services on the Site, including booking a room for accommodation at the Company’s hotels, is on a space-available basis only.<\/p>\n\n\n\n
7.4. Promotions and Benefits<\/p>\n\n\n\n
Unless explicitly stated otherwise, no more than one promotion, discount, or benefit may be redeemed in connection with the same order.<\/p>\n\n\n\n
7.5. Check-in and Check-out Times<\/p>\n\n\n\n
7.5.1. Check-in is from 15:00, unless otherwise stated in the order confirmation. Check-in on Saturdays will be at 18:00.<\/p>\n\n\n\n
7.5.2. Check-out is by 11:00, unless otherwise stated in the order confirmation. Check-out on Saturdays at the Tel Aviv and Jerusalem hotels will be at 12:00, and at the resort hotels at 14:00.<\/p>\n\n\n\n
7.5.4. A request for early check-in or late check-out is subject to the approval of hotel management, room availability, and additional payment.<\/p>\n\n\n\n
7.5.5. The Company may update check-in and check-out times depending on the hotel, season, holidays, or special events, and the binding information will be that which appears in the order confirmation.<\/p>\n\n\n\n
7.6. Infants and Children<\/p>\n\n\n\n
7.6.1. For these Terms of Use:<\/p>\n\n\n\n
“Infant” \u2013 a person who has not yet reached the age of two.<\/p>\n\n\n\n
“Child” \u2013 a person who has reached the age of two and up to (not including) the age of 12.<\/p>\n\n\n\n
7.6.2. To the extent an order includes two or more infants in the same room, the Company may charge for one of them at the child rate, in accordance with the hotel’s policy and room occupancy.<\/p>\n\n\n\n
7.6.3. Accommodation of minors under the age of 18 will be permitted only when accompanied by at least one guest aged 18 or over.<\/p>\n\n\n\n
7.7. Additional Guests<\/p>\n\n\n\n
Guests may not accommodate or host more guests than the number specified in the reservation without the hotel’s prior written approval. The Company reserves the right to charge an additional fee for the accommodation of any additional guests.<\/p>\n\n\n\n
7.8. Hotel Equipment<\/p>\n\n\n\n
Equipment belonging to the hotel may not be removed from the accommodation rooms or the hotel premises. For use of sea beaches, pools, or water sources outside the hotel premises, [text incomplete in the original document].<\/p>\n\n\n\n
7.9. Smoking<\/p>\n\n\n\n
Smoking, including the use of electronic cigarettes to the extent the law or the hotel’s policy applies the same restrictions to them, is prohibited throughout the hotel premises, except in areas explicitly designated for that purpose by hotel management.<\/p>\n\n\n\n
7.10. Liability for Damages<\/p>\n\n\n\n
The user is responsible, jointly and severally with all guests included in the order, for safeguarding the hotel’s property and for avoiding damage to the hotel, the accommodation rooms, its facilities, or the equipment they contain.<\/p>\n\n\n\n
To the extent damage is caused as a result of an act or omission by the user or any of the guests on the user’s behalf, the Company may charge the user for the cost of repairing the damage or replacing the damaged equipment, in accordance with its actual cost and subject to the provisions of any law. For this purpose, the Company may use the payment details provided as part of the order, after notifying the user of the nature of the damage and the amount to be charged.<\/p>\n\n\n\n
8.1. The Company may, at its sole discretion, offer promotions, discounts, benefits, discount coupons, club-member benefits, or any other marketing offer (collectively, “Promotions”) on the Site from time to time. The Company may change, update, extend, discontinue, or cancel any promotion, in whole or in part, at any time.<\/p>\n\n\n\n
8.2. Each promotion is subject to its terms as published on the Site or in any other Company publication. In the event of a conflict between the provisions of the Terms of Use and the terms of a particular promotion, the terms of that promotion shall prevail, to the extent explicitly stated therein.<\/p>\n\n\n\n
8.3. The user has no vested right to enjoy any promotion, benefit, or discount. The user’s eligibility for a promotion will be examined at the time the order is placed and in accordance with its terms. Any change to the order, including a change in stay dates, room type, order scope, number of guests, or any other material detail, may result in a re-examination of eligibility for the promotion, benefit, or discount, and the Company may update the order price in accordance with the terms in effect at the time of the change.<\/p>\n\n\n\n
8.4. In the event of cancellation of a transaction made as part of a promotion or while redeeming a benefit, and to the extent the user is entitled to a refund in accordance with the provisions of the law and the order terms, only the amount actually paid by the user will be refunded, after deducting any discount, benefit, or promotion given as part of the transaction.<\/p>\n\n\n\n
8.5. Where a benefit or promotion is conditional on the purchase of several services or products together, including “1+1” promotions, free nights, combined packages, or any similar promotion, cancellation of one of the services or products included in the promotion may result in cancellation of the entire benefit and an update of the transaction price in accordance with the regular price of the remaining services or products, or in cancellation of the entire transaction, in accordance with the terms of the promotion and the provisions of the law.<\/p>\n\n\n\n
8.6. Unless explicitly stated otherwise, multiple promotions, discounts, benefits, coupons, or credits may not be accumulated or combined within the same order.<\/p>\n\n\n\n
9.1. The images, renderings, videos, plans, descriptions, and any other visual material appearing on the Site are for illustrative purposes only. There may be differences between the actual appearance of the rooms, facilities, or hotels and their presentation on the Site, including due to camera angles, lighting conditions, renovations, upgrades, equipment replacement, or other changes.<\/p>\n\n\n\n
It is clarified that the Site does not necessarily display all room types or all rooms in every hotel, and there may be differences between rooms of the same type, all subject to the standards customary at the relevant hotel.<\/p>\n\n\n\n
9.2. The information appearing on the Site is presented “as is” and is intended for general informational purposes only. The Company makes reasonable efforts to update the information and ensure its accuracy; however, errors, inaccuracies, omissions, or changes may occur from time to time. The information on the Site does not constitute a representation, undertaking, or binding opinion, unless explicitly stated otherwise.<\/p>\n\n\n\n
9.3. Use of the Site and of the services offered on it is at the user’s sole responsibility. The Company shall not be liable for any damage, loss, expense, or inconvenience caused as a result of use of the Site, reliance on the information appearing on it, or its unavailability, except to the extent liability is imposed on it by law.<\/p>\n\n\n\n
9.4. The Company does not undertake that the Site will operate continuously, without malfunctions, interruptions, or errors, or that it will be immune from unauthorized access, viruses, hardware or software malfunctions, or communication-network failures. The Company will use reasonable means to fix malfunctions as they are discovered.<\/p>\n\n\n\n
9.5. The user undertakes to provide true, complete, and accurate information when using the Site. The user will be liable for any damage caused as a result of providing incorrect, incomplete, or misleading information.<\/p>\n\n\n\n
9.6. To the extent a competent court determines in a judgment that the Company is liable for damage caused to a user, the Company’s liability shall be limited, to the extent permitted by law, to direct damages only, caused as a result of an act or omission by the Company. Without derogating from the provisions of any law, the Company’s cumulative liability for any cause of action related to a particular order shall not exceed the amount actually paid by the user for that order in respect of which the cause of action arose.<\/p>\n\n\n\n
The user undertakes to indemnify the Company, its employees, officers, owners, and anyone acting on its behalf, for any damage, loss, expense, payment, liability, demand, or claim, including legal costs and attorneys’ fees, incurred as a result of a breach of the Terms of Use by the user, unlawful use of the Site or its services, breach of any law,<\/p>\n\n\n\n
11.1. The Company may send the user, by electronic means, documents, notices, and updates relating to orders placed or services purchased, including by email, SMS text messages, instant messages, or any other means of communication provided by the user to the Company.<\/p>\n\n\n\n
11.2. Such documents and notices may include, among other things, order confirmations, cancellation confirmations, tax invoices, receipts, credits, disclosure documents, service notices, documents required by law, and any other document related to the order or the provision of the service. The user’s use of the Site constitutes agreement to receive such documents by electronic means.<\/p>\n\n\n\n
11.3. The user is responsible for ensuring that their email inbox and other means of contact provided are available to receive notices, including checking spam folders or message filtering. The Company shall not be liable for failure to receive a notice due to incorrect contact details provided, failure to update them, or a malfunction beyond its control.<\/p>\n\n\n\n
12.1. The Company may offer the user the option to join its mailing list and receive updates, newsletters, information about services, promotions, benefits, discounts, events, new products, as well as advertising materials, as defined in the Communications Law (Telecommunications and Broadcasting), 5742\u20131982 (the “Advertising Materials”).<\/p>\n\n\n\n
12.2. To the extent the user has given explicit consent, the Company may send the user Advertising Materials via the means of communication approved by the user, including by email, SMS messages, WhatsApp, instant messages, an automatic dialing system, or any other means of communication permitted by law.<\/p>\n\n\n\n
12.3. The user may withdraw their consent to receive Advertising Materials at any time, free of charge, by clicking the unsubscribe link attached to email messages, by replying “unsubscribe,” or in another manner specified in the message, and the Company will act to remove the user from the mailing list in accordance with the provisions of the law.<\/p>\n\n\n\n
12.4. Removal of the user from the mailing list does not prevent the Company from sending operational messages, service messages, or messages required for managing the order and\/or the stay at the hotel, which do not constitute “advertising material” under law.<\/p>\n\n\n\n
The user undertakes not to make any use of the Site or its content that is prohibited by law or contrary to these Terms of Use, including:<\/p>\n\n\n\n
13.1. Use of the Site for an unlawful, commercial, or unauthorized purpose.<\/p>\n\n\n\n
13.2. Copying, duplicating, distributing, translating, processing, creating derivative works, reverse engineering, decompiling, selling, renting, or otherwise using the Site’s content or the Company’s intellectual property without prior written authorization. Collecting, data mining, scraping, or retrieving information from the Site, including users’ personal information, by manual or automated means, without prior written authorization.<\/p>\n\n\n\n
13.3. Damaging, disrupting, interfering with, or attempting to bypass the Site’s security measures, its servers, systems, or its proper operation.<\/p>\n\n\n\n
13.4. Violation of any law or of any provision of these Terms of Use.<\/p>\n\n\n\n
13.5. In the event of use in violation of this section, the Company may deny the user access to the Site, cancel orders, suspend or block use of the Site, and take any other remedy available to it under law.<\/p>\n\n\n\n
14.1. These Terms of Use, use of the Site, and any engagement between the user and the Company shall be governed solely by the laws of the State of Israel.<\/p>\n\n\n\n
14.2. Jurisdiction over any dispute relating to these Terms of Use or use of the Site shall be vested in the competent courts in Israel, in accordance with the provisions of law.<\/p>\n\n\n\n
14.3. If any provision of these Terms of Use is determined to be unlawful, void, or unenforceable, this shall not affect the validity of the remaining provisions of the Terms of Use.<\/p>\n\n\n\n
14.4. In accordance with the Law for the Reduction in the Use of Cash, 5778\u20132018, in a transaction with a dealer (the hotel), payment may not be made in cash for an amount exceeding 10% of the transaction price or NIS 6,000, whichever is lower. For guests who are not residents of Israel, cash payment is permitted up to an amount of NIS 40,000.
